After the case is opened, you must prepare the Summons using local form 7-2 or 11-2 and drop it off at the Intake counter to be issued.

Eligible Chapters that can file a Summons to Debtor in Involuntary Case

An involuntary case may be commenced only under chapter 7 or 11 of this title, and only against a person, except a farmer, family farmer, or a corporation that is not a moneyed, business, or commercial corporation, that may be a debtor under the chapter under which such case is commenced.

Filing Requirements

 

Step-by-Step Procedures:

  1. Go to www.ilnb.uscourts.gov

  2. Select the Judge's Tab

  3. Verify the County on the case and select the Judge's case schedule for that County


    Take note of the Judge's NON sitting dates

  4. Select from an available date, time, and location for status hearing

     

  5. Complete all required fields on either form 7-2 Summons to Debtor in Involuntary Case or 11-2 Summons to Debtor in Involuntary Case

    • Division
    • Case Number
    • Chapter
    • Alleged Debtor's Name
    • Date of Filing
    • Name and Address of the Clerk of the Bankruptcy Court
    • Address for the Status Hearing Room, Date and Time

     

  6. Return Summons in person to the Bankruptcy Court for Issuance

 

Bring Original and 1 Copy for each party to be served
